📋 Terms & Conditions

1. Acceptance of Terms

By registering, accessing, or using Azomart's services (including buying, selling, or browsing), you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions, our Privacy Policy, Refund Policy, Delivery Policy, and all applicable laws of India.

2. Eligibility

To use Azomart, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into contracts
• Provide accurate and complete registration information
• Not be restricted from using our services under any applicable laws
• Have a valid delivery address within 20km radius of Rodayan, Sasni, Hathras (PIN: 204216)

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to:

• Notify us immediately of any unauthorized account access
• Not share your account with others
• Be fully responsible for all activities under your account
• Provide accurate and up-to-date information (especially delivery address)
• Not create multiple fake accounts

4. Seller Terms

If you register as a seller on Azomart (Local Seller from Rodayan, Sasni, Hathras or nearby areas):

• You must provide valid KYC documents (Aadhar Card, PAN Card, Bank Account details)
• You are responsible for product quality, pricing, and availability
• Products must be legal, authentic, and safe for consumers
• Products must be stored within 20km radius for fast 24-hour delivery
• Azomart reserves the right to remove any product that violates our policies
• Commission charges: 10% on each successful sale (minimum ₹10)
• Payments are settled within 7-14 days after order delivery confirmation
• Sellers must comply with local tax regulations (GST, etc.)

5. Buyer Terms

As a buyer on Azomart:

• You agree to pay the listed price for products you purchase + ₹29 delivery charge
• You are responsible for providing accurate shipping address within 20km radius of Rodayan, Sasni
• You agree to receive order updates via SMS, WhatsApp, and email
• Fake orders or fraudulent activities will be reported to Hathras police authorities
• You must respect seller's intellectual property rights
• Minimum order value: ₹50 (excluding delivery charge)
• Maximum order value for COD: ₹5,000

6. Prohibited Activities

You agree NOT to:

• Violate any laws or regulations of India
• Infringe on intellectual property rights
• Post false, misleading, or fraudulent information
• Hack, disrupt, or damage our platform
• Scrape or copy our content without permission
• Engage in money laundering or illegal transactions
• Create multiple fake accounts
• Place fake orders to harm sellers
• Share inappropriate or offensive content

7. Product Listings & Pricing

• Sellers are responsible for accurate product descriptions and images
• Prices are subject to change without notice
• We reserve the right to correct pricing errors
• Discounts and offers are subject to terms and conditions
• All prices are in Indian Rupees (INR)
• GST as applicable will be added at checkout

8. Payment Terms

• All payments are processed through secure payment gateways (Razorpay, etc.)
• Cash on Delivery (COD) available for orders within 20km radius of Rodayan, Sasni
• COD Handling Fee: ₹20 extra + ₹29 delivery charge
• Azomart does not store your payment card information
• Refunds are processed according to our Refund Policy (within 24 hours)
• Fraudulent transactions will be reported to cyber crime authorities
• UPI, Net Banking, Credit/Debit Cards, and Wallet payments accepted

9. Delivery Terms

• Delivery within 24 hours from order confirmation (guaranteed)
• Delivery only within 20km radius from Rodayan, Sasni, Hathras
• Flat ₹29 delivery charge on all orders
• Orders placed before 2 PM: Same day delivery by 7 PM
• Orders placed after 2 PM: Next day delivery by 7 PM
• Express delivery (2-4 hours): Additional ₹50 (₹79 total)
• Delivery outside 20km radius: Order will be automatically cancelled
• Wrong address provided: Order cancelled, delivery fee charged

10. Intellectual Property

All content on Azomart including logos, images, text, graphics, software, and the name "Azomart" is the property of Azomart or our licensors and is protected by Indian copyright laws. Unauthorized use is prohibited.

11. Limitation of Liability

Azomart is not liable for:

• Indirect or consequential damages
• Loss of profits, data, or business opportunities
• Delays caused by third-party service providers
• Force majeure events (natural disasters, strikes, floods, pandemics, etc.)
• Product quality issues (seller is responsible)
• Delivery delays due to incorrect address provided by customer

Maximum liability: Refund of order value only, not exceeding ₹10,000 per transaction.

12. Account Suspension & Termination

We may suspend or terminate your account without notice for:

• Violation of these terms
• Fraudulent or illegal activities
• Multiple customer complaints (3+ complaints)
• Non-payment of fees (for sellers)
• Providing false information
• Abusing delivery partners or customer support

13. Dispute Resolution & Governing Law

Any disputes arising from these terms shall be:

• Governed by the laws of India
• Subject to the exclusive jurisdiction of courts in Hathras, Uttar Pradesh
• First attempted to resolve through mutual discussion within 15 days
• If unresolved, legal proceedings will be in Hathras courts only

14. Force Majeure

Azomart shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to: acts of God, war, riots, embargoes, floods, fires, earthquakes, pandemics, government orders, or delivery partner strikes.

15. Amendments to Terms

We reserve the right to modify these terms at any time. Changes become effective immediately upon posting on this page. Your continued use of Azomart after changes constitutes acceptance of the modified terms. Significant changes will be notified via email or SMS.
